1. Identify the actor

Regulator, exchange, market infrastructure, licensed corporation, registered institution, individual licensee, issuer, intermediary, and client responsibilities are not interchangeable.

2. Name the activity or transaction

Decide whether the facts concern a regulated activity, client advice or execution, custody, record keeping, exchange participation, an offer, listing, disclosure, investigation, discipline, or trading conduct.

Application, approval, ongoing compliance, detection, notice, response, decision, appeal, and enforcement call for different actions. Do not answer an application-stage question with a final penalty.

4. Extract the controlling facts

Keep activity type, institutional status, individual role, client classification, document, authorization, timing, knowledge, intent, control, and transaction facts. Ignore ornamental detail.

5. Apply the narrow duty or power

Use the rule assigned to this actor and stage. Do not import a nearby Companies Ordinance, SFO, code, listing, or exchange mechanism merely because it sounds protective.

6. Choose the supported action or consequence

The best option should solve the stated issue without assuming missing authority, skipping a safeguard, or selecting a consequence that belongs to another forum.
